| 10 | Notable achievements |
When he was reverted from SP to ASP in the year 1958,
he challenged the order of his reversion in the High Court.
The High Court dismissed his petition and he went in appeal to the
Supreme Court and got the order of his reversion set aside. Arguing,
PERSONALLY, his petition before a Constitution Bench of the Supreme Court
he contended that even as officiating SP, he had under the AIS rules, the
right to officiate as SP so that his reversion tantamounted to Reduction
in Rank. Mr. S.V. Gupte Additional Solicitor General of India had
represented Union of India and Punjab Govt., but his contention was upheld
by the Supreme Court, which set aside the order of his reversion holding
the same as violative of Art. 311 of the Constitution of India.
This case was reported as AIR 1964 SC 423. Thereafter, when he was posted as DIG/Vigilance HSEB,
he was neither given any Special Pay nor was given Deputation Allowance.
He challenged this also in the High Court, which dismissed his
petition. He went in appeal
to the Supreme Court and got the Deputation Allowance. This judgment was
reported as AIR
1981 SC 1540. Another important achievement has been about the
judgment he got from Hon’ble High Court against the writing of ACR on
the work and conduct of IGP by the Home Secretary. His ACR as IG Police,
was then, written by the Home Secretary.
His contention was that the Home Secretary, under the Law and
Rules, could not write his ACR. Single Bench of the High Court dismissed
his petition. He filed Letters Patent Appeal against that order. The
Division Bench of the High Court allowed the LPA against which the State
Government went in appeal to the Supreme Court, which also dismissed the
appeal and upholding his contention held that IGP’s ACR had to be
written by Home Minister and not by Home Secretary.
He had argued the case HIMSELF both in the High Court as well as in
the Supreme Court. The
counsel for the State was Mr. F.S. Nariman. The case is reported as AIR
1987 8C 1201. Another important case, which he filed in the Punjab
and Haryana High Court was against the non-grant of two advance increments
for getting his LL.B. Degree during his service and improving his basic
qualifications for joining the Indian Police Service. This case is
reported as SLR 2982 P & H34. Yet another case, he recently got from the Central
Administrative Tribunal has been that he was entitled to restoration of
commuted portion of his pension after 12 years of retirement on attaining
the age of 70 years, as per rules applicable to Class-I State Government
Employees read with AIS (Residuary Matters) Rules. |

His wife, Smt. Nirmal Wadhwa, is a housewife. His eldest daughter, M.Sc. in Computer Science, is in
USA. His second daughter is Masters in Dental Surgery and
is in U.K. His son had a Doctorate Degree in USA and is a
Professor in Columbia University, New York. |
| 17 | Impressions about IPS career | He has been, on the whole, very happy in his career as an IPS officer. He believed that what an honest Police officer can do for the society, no person of any other branch of Government service can do. He, thus, had a great sense of satisfaction as an IPS Officer. As an IPS officer he did many things in his service career which earned him the goodwill and appreciation of the public wherever he was posted. |
